YET ANOTHER NEW POSTING REQUIREMENT

Last month changes to the Fair Employment and Housing Council’s (FEHC) Family Care and Medical Leave (CFRA Leave) and Pregnancy Disability notice were approved.  The new notice, Family Care and Medical Leave and Pregnancy Disability Leave must be posted by any employer subject to the the California Family Rights Act and the New Parent Leave Act.

The new poster includes information on the New Parent Leave Act (NPLA).  NPLA is an extension of CFRA, requiring employers with 20-49 employees, within a 75-mile radius, to offer up to 12 weeks of unpaid leave for baby-bonding.

As with CFRA, in order for an employee to be eligible, the employee must have worked for at least 12 months for the employer (need not be consecutive) and 1250 hours in the previous 12 months.  Employers may limit parents, working at the same location, to a combined 12 weeks of leave.

For employers who have already purchased and posted the all-in-one state and federal poster, you can download the poster https://www.dfeh.ca.gov/wp-content/uploads/sites/32/2017/06/CFRA_PregnancyLeave_English.pdf and replace with the older version.  This poster and the posting requirements are effective April 1, 2019.
