As SDEA stated in a previous newsletter Covid Flexibility, which allowed employers to view I-9 documents remotely in conjunction with Covid restrictions, is ending effective July 31, 2023.
During COVID employees working remotely were exempted from the physical inspection requirements associated with the Employment Eligibility Verification (Form I-9).
Employers who did not conduct a physical inspection of I-9 documents during that time should have documented the date that physical documents were actually inspected in the “Additional Information” box located on page 2 of the I-9 at the time that employees returned to the office, either full-time or hybrid.
Employers have until August 30, 2023 to ensure that physical documents have been reviewed and documented.
That means employers will now need to (re)inspect those documents or any document presented to the employer for the purposes of the I-9 (need not be the same document(s) used originally).
San Diego employers who are fully remote, and therefore don’t have offices where they can ask employees to bring their physical documents for recertification, are struggling with how to make these mandatory updates. If that is your situation, SDEA can update your I-9s for you.
